Eligibility. This “Choose Your Own Team Gear + $100 in DraftKings Sportsbook Bonus Bets” Sweepstakes (“Sweepstakes”) is open only to natural persons who: (i) are physically present in Colorado, Massachusetts, Maine, New Hampshire, New Jersey, New York, Ohio, Oregon, Washington DC and West Virginia (“Participating Jurisdictions”); (ii) are at least twenty one (21) years old at the time of entry, excluding individuals referenced in the “Sponsor” paragraph below; (iii) are not voluntarily or involuntarily excluded (including self-exclusion) from play on DraftKings; (iv) are not included on any jurisdiction-wide gaming or daily fantasy sports exclusion list; (v) are not temporarily or permanently banned from playing on any DraftKings website or mobile application; (vi) maintain any DraftKings accounts in good standing; and (vii) satisfy all other requirements contained herein.  Additionally, any winner requires a DraftKings Sportsbook account that is not locked, excluded or otherwise inactive in order to access and use the DraftKings Sportsbook Bonus Bets (“Bonus Bets”). Void outside of the Participating Jurisdictions, and where prohibited.  This Sweepstakes is subject to all applicable federal, state, and local laws and regulations.

Sponsor. The Sweepstakes sponsors are Jackpocket LLC and Crown Gaming Inc. (collectively, “Sponsor”), located at 222 Berkeley Street, 5th Floor, Boston, MA 02116.  Sponsor and its affiliates, parents, subsidiaries, successors, assigns, agents, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Sweepstakes, and their respective representatives, officers, directors, shareholders, members and employees, including without limitation, the immediate family and/or household members of such individuals, are not eligible to participate.  

Entry Period.  This Sweepstakes begins on October 4th,  2024 at 6:00:01 PM Eastern Prevailing Time (“ET”) and ends on October 31st, 2024 at 11:59:59 PM ET (“Entry Period”).  All times are measured by Eastern Prevailing Time (“ET”).  The Sponsor’s database computer is the official timekeeping device for the Sweepstakes.  Each “day” for purposes of these Official Rules is measured by ET.

How to Enter.  During the Entry Period, there are two (2) ways to enter.

1. Entry with Purchase Via Jackpocket App:  First, download or open the Jackpocket mobile application (the “Jackpocket App”) and navigate to the Giveaway Page in the Jackpocket App; second, tap ‘Activate’ for this Sweepstakes; and third, place an official state lottery ticket order on the Jackpocket App from the state lottery where you are physically located in one of the Participating Jurisdictions.  Every one dollar ($1.00) spent on such ticket orders in the same Jackpocket account during the Entry Period after this Sweepstakes has been activated in that Jackpocket account is equal to one (1) entry in this Sweepstakes without need to activate again.  Tapping ‘Activate’ does not provide a discount to purchase and is used only to trigger and keep track of entries. For new Jackpocket customers, placing an order will require downloading the Jackpocket App, opening and registering a Jackpocket account, and funding the account prior to placing the order.  All use of the Jackpocket App is subject to its general terms and conditions at jackpocket.com/tos.  Lottery ticket orders made using promotional credits and/or promotional funds will not provide any entries in the Sweepstakes for the amounts of such promotional credits and/or promotional funds.

In order to enter with purchase via the Jackpocket App, you must have the following versions of iOS or Android, as applicable, installed: 

Jackpocket Android Version 2.13.7 or higher
Jackpocket iOS Version 2.13.8 or higher

2. Free Entry via Website: You may also enter for free, without any purchase, by doing the following: First, download the Jackpocket App and open and register an account, which is free to do; and second, after creating your Jackpocket account, during the Entry Period, go to https://jackpocket.typeform.com/to/LuhghpYU (the “Site”), and complete the typeform located there with the following information: full name, phone number, mailing address and the email address you used to register your Jackpocket account.  Each time you properly complete and submit the typeform on the Site, you receive ten (10) entries, which is equal or greater than the average number of dollars currently spent per day by customers of the Jackpocket App to purchase state lottery tickets. IMPORTANT: The email address that you enter in the typeform MUST match the email address that you used to register your Jackpocket account. If the email addresses do not match, then you will not receive any entries for the typeform on which the email addresses did not match. Upon successful completion of both of the steps noted hereunder, you do not need to fund your Jackpocket account in order to enter the Sweepstakes during the Entry Period and registering for a Jackpocket account is free. 

Limitations on Entries. LIMIT OF ONE HUNDRED (100) ENTRIES PER PERSON PER DAY DURING THE ENTRY PERIOD, REGARDLESS OF METHOD OF ENTRY, INCLUDING ANY COMBINATION OF ENTRIES GENERATED BY EITHER OR BOTH OF THE METHODS DESCRIBED ABOVE.  Any attempt to submit more than the stated limit on entries by any means, including but not limited to use of multiple accounts, identities, email addresses or otherwise is grounds for disqualification.  Each individual must submit his/her own entries.  No third-party entry or entry through any sweepstakes service is permitted.  Use of robotic or any other automated means of entry is strictly prohibited.

Winners and Prizes.  Three (3) winners will be chosen.  For each winner, the prize is as follows:

The total ARV of all prizes available for award is two thousand dollars ($900.00). Prize awarded in the form of a $200 Visa Gift Card that the winners can use towards a tailgating party or for any other purpose. Visa is a registered trademark of Visa, Inc., which is not a sponsor of or associated in any way with this Sweepstakes.  The DraftKings Sportsbook Bonus Bet will be delivered to the winner via one (1) bonus bet “token” deposited into the winner’s Online DraftKings Sportsbook account. Winner must have an Online DraftKings Sportsbook account to receive the prize. In the event that the winner does not have an existing Online DraftKings Sportsbook account, the winner may create an Online DraftKings Sportsbook account at https://sportsbook.draftkings.com/sportsbook by clicking the “Join” button. Creating an Online DraftKings Sportsbook account is free. Each bonus bet is valid for seven (7) calendar days, and such seven (7) calendar day period is measured as one hundred sixty-eight (168) hours from the time the bonus bet is deposited by Sponsor into the winner’s Online DraftKings Sportsbook account. Failure by a winner to use their bonus bet before expiration will void the bonus bet. Awarded bonus bets are non-cashable, not redeemable for cash, non-transferable, non-refundable, and cannot be withdrawn. Bonus bets may only be wagered one (1) time. The bonus bet amount is not included in any returns or winnings. Winnings generated from the wagering of a bonus bet will be transferred to the winner’s cash balance of their Online DraftKings Sportsbook account, at which time such winnings may be withdrawn. By way of example, and for illustrative purposes only, in the event a ten-dollar ($10) bonus bet is placed on even odds and wins, only the profit of ten dollars ($10) will be credited to the winner’s Online DraftKings Sportsbook account. Bonus bets cannot be used with odds boosts, live bets, parlays, cash out bets, or other promotional bets at the discretion of Sponsor. The winner may only use the bonus bet when physically located in Arizona, Colorado, Connecticut, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, New Hampshire, New Jersey, New York, North Carolina, Ohio, Oregon, Pennsylvania, Tennessee, Vermont, Virginia, West Virginia, Wyoming, or any parish in Louisiana where a majority of the qualified electors in the parish voted for the proposition to authorize  sports wagering activities. The bonus bet is subject to the DraftKings Online Sportsbook Terms of Use for the applicable state you are using the bonus bet in as well as the DraftKings Sportsbook Betting Agreement available at https://sportsbook.draftkings.com/help/general-betting-rules/general-rules. Additional restrictions, conditions, and limitations may apply.

Limit of one (1) prize per person.

Winners are solely responsible for any applicable federal, state, and local taxes as a result of acceptance of the prize.  Sponsor shall provide winners with applicable tax forms for withholding purposes and winners must return to Sponsor a W9 or W-8 BEN tax form, as applicable, prior to receiving the prize, if any such forms are required to be provided by Sponsor. Prizes may be subject to tax withholdings as required by law. Winners are solely responsible for determining winners’s tax liability that is in addition to or different from that described in this section. No substitution or transfer of prize except in Sponsor’s discretion; provided that if the advertised prize becomes unavailable for any reason, an alternate prize of comparable value may be awarded.  If winners’s DraftKings account is locked, excluded or otherwise inactive, winners must reactivate the account to use the Bonus Bets. 

Drawing.  Winners will be selected in a random drawing from among all eligible entries collected during the Entry Period, taking place on or about five (5) business days after the end of the Entry Period.  Decisions of the judges are final and binding on all matters relating to the Sweepstakes and these Official Rules.  Any entrant or potential winners may be disqualified and forfeit prize if they are not eligible or violate a rule, gained unfair advantage in the Sweepstakes, or obtained winner status using fraudulent means.  If there is a dispute about the identity of an entrant, prize will be awarded to the natural person associated with the Jackpocket account or provided by email.  If a winner is found to be ineligible or not in compliance with Sweepstakes rules, such winner will be disqualified and an alternate winner will be awarded the prize.  Each potential winner will be notified by in-Jackpocket App message and/or email using information associated with their Jackpocket account. Bonus Bets will be credited to the DraftKings Sportsbook account of the winners within three (3) business days after winners have been verified, including completing any necessary documentation as provided herein. If any prize is returned as undeliverable, then such prize will be forfeited and another winner may be randomly drawn.  Each potential winner may be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release; failure to comply when requested may result in disqualification and award of prize to an alternate winner.

Odds.  The odds of winning will depend on the number of eligible entries received.

WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

General Terms.  By entering this Sweepstakes, you promise to abide by the Official Rules and decisions of the Sweepstakes judges.  Sponsor will not be responsible for any injury, damage, or loss of any kind arising out of your participation in the Sweepstakes.  By entering, you release and agree to hold harmless the Sponsor and its parent, subsidiary, and affiliated companies, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present parents, affiliates, officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to your participation in the Sweepstakes other than any obligation to award a prize in accordance with these Official Rules.

Except where prohibited by law, by accepting the prize, winners grant Sponsor a perpetual, worldwide, royalty-free license to use winners’s name, photograph, voice and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world, including, without limitation, in social media advertisements and announcements. 

Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein.  If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winners in a random drawing from all eligible, non-suspect entries unaffected by the problem.  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances. 

Only the type and quantity of prizes described in these Official Rules will be awarded.  If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winner, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s).  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.

By entering the Sweepstakes, you further agree that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney's fees; and (c) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses.  These rules and any disputes relating hereto are governed by the internal laws of the Commonwealth of Massachusetts without regard to principles of conflicts of laws, and by entering, you consent to the exclusive jurisdiction of the state and federal courts in the Commonwealth of Massachusetts for resolution of any disputes relating to the Sweepstakes and waive any objection thereto.

Winner’s Name.  For the winners’s name, available approximately fifteen (15) days after the Entry Period closes, please visit the Giveaway Page in the Jackpocket App or contact Sponsor by email at giveaways@jackpocket.com and include the name of the Sweepstakes in your email.  All such requests must be received within sixty (60) days after the Entry Period.
