OFFICIAL RULES

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED. 

ELIGIBILITY:  The Jackpocket Winner of the Year Contest (the “Contest”) is a contest of skill open to legal residents of the 50 United States and D.C., 18 years of age or older.  Employees, officers, or directors of Jackpocket Inc. (“Sponsor”), or any of its parents, subsidiaries, affiliates, or any advertising or promotion agencies involved in this Contest (collectively, the “Contest Entities”), as well as the immediate family (children, siblings, and parents) and household members of each such person (whether related or not), are not eligible to enter.  Void where prohibited. 

CONTEST PERIOD: The Contest begins on December 8, 2022, at 9:00:01 a.m. Pacific Time (“PT”), and ends on December 15, 2022, at 11:59:59 p.m. PT (the “Contest Period”). The Sponsor’s database computer is the official time-keeping device for the Contest.

HOW TO ENTER:  There are two (2) ways to Enter during the Contest Period:

1.  Log in to any of Instagram, Twitter, or TikTok (each, a “Social Media Platform”), follow @jackpocket, and post a video, photo(s) (with caption), or short story sharing your “most wonderful win of the year” (“Win”) with the hashtag #My2022WinContest and tag @jackpocket (“Post”). The Win can be any interpretation of winning and does not need to involve a lottery or other financial gain, but also can be in any other aspect of your life. The Win can be big or small, as long as it made you feel like a winner (the “Theme”). 

Important Details for Twitter and Instagram Posts:  

a. If you choose Twitter for your Post, then to complete your entry, you must also retweet the first announcement Jackpocket posts about the Contest on December 8, 2022. 

b. If you choose Instagram, your Post can be a Feed post or Reel and then to complete your entry, you must also “like” the first announcement Jackpocket posts about the Contest on December 8, 2022.  Alternatively, you can enter on Instagram by commenting your win with the hashtag #My2022WinContest under Jackpocket’s first announcement post on December 8, 2022 and “liking” the first announcement Jackpocket posts about the Contest on December 8, 2022.

2.  Visit the Sponsor’s VideoAsk portal at https://www.videoask.com/f6k630cw5 to either (a) record a video or audio description of your Win, or (b) upload video, audio, images (with written caption), or written text sharing your Win (“VideoAsk Submission”).

Posts and VideoAsk Submissions collectively are “Submissions.”  Limit one (1) Submission/entry per person overall, regardless of method of entry or Social Media Platform used.  If you enter via a Social Media Platform, you must have an account on that Platform, and your Account must be set to “public” so we can see your Post.  Accounts are free.  All Posts are subject to the applicable Social Media Platform’s terms of use.  Use of any macro, bot, script, or other automated means to submit entries is prohibited.  Any attempt to submit more than one (1) Submission by use of multiple names, Accounts, or any other means is grounds for disqualification, as is sharing of Accounts.  Submissions will not be acknowledged or returned.  In the event of a dispute over the identity of an entrant, the Submission will be deemed made by the authorized account holder of the email address associated with the Account used to make the Post or submitted with the VideoAsk Submission.  “Authorized account holder” is defined as the natural person who is assigned to an email address associated with the relevant social media account or VideoAsk Submission.

SUBMISSION REQUIREMENTS:  

• All VideoAsk Submissions must be 10 MB or less.  

• Videos submitted via any means should not exceed 90 seconds and must be in in one of the following formats: WEBM, MP4, M4V, MOV, AVI, WMV, OGG, 3GPP, or MPEG (or any other format accepted by an applicable Social Media Platform).  

• Audio clips should not exceed 90 seconds, and must be in one of the following formats: WEBA, WAV, MP3, OPUS, or ACC (or any other format accepted by a Social Media Platform).  

• Images must be in one of the following formats: PNG, JPG, JPEG, SVG, GIF, or ICO.  Accompanying caption/text can be in TXT or CSV format.

• All spoken or written content must be in English.

• Any photo submission must include a written caption describing your Win.  Omission of written content will mean the Submission cannot be judged as a potential winner. 

• All written content (story, caption, etc.) should be 250 words or less.

In addition, all Submissions must: (a) be the exclusive original work of the entrant; (b) be in keeping with the Sponsor’s image; (c) not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon the rights of any person or entity, including but not limited to copyright, trademark, privacy or publicity; (d) not contain any commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans other than the Sponsor’s; (e) not depict any conduct or content that is unsafe, immoral, obscene, or otherwise inappropriate; and (f) not have been submitted in any other Contest or won any prize.

Each entrant represents and warrants that he/she has obtained permission from any and all recognizable persons other than the entrant depicted in a Submission, that all such persons are 18 years of age or older and agrees, upon request, to furnish written proof of such permission.  Failure to meet any of the requirements above, or to otherwise comply with these Official Rules, may result in disqualification.  Sponsor reserves the right to delete or blur any inappropriate content from a Submission without disqualifying the entry where such change does not materially alter the submission and the entrant has otherwise attempted in good faith to comply with these Official Rules. 

JUDGING/WINNER SELECTION:  Judging: All eligible Submissions will be judged initially by a panel of judges using the following criteria: creativity and originality, best representation of the Theme, quality of spoken/written expression, and public appeal.  For photo Submissions, judging will be based on the accompanying written caption/content.   Judges’ decisions are final and binding on all matters relating to the Contest.  At the close of the Contest Period, the judges will select a maximum of three (3) finalists based on the criteria specified above (“Finalists”).  Fewer Finalists may be selected if an insufficient number of Submissions are received of adequate quality, as determined by the judges. 

Public Voting: Submissions of the Finalists will be posted at each Social Media Platform as a pin on the top of each respective @jackpocket Social Media Platform page from approximately December 16, 2022 to December 18, 2022 (“Voting Period”), to allow the public the opportunity to cast a vote for their favorite by “liking” their favorite Finalist.  Voting instructions will be available on the voting page.  Limit one (1) vote per person per Social Media Platform.  Use of script, macro, or any device to automate voting, hiring outsourced vote-farming services, paying for votes, or engaging in any other conduct deemed inappropriate, disruptive, or unsportsmanlike as determined by the Sponsor in its discretion is prohibited, and any entries or votes received through such means will be void.  Any attempt by any voter or entrant to submit or solicit more than the stated number of votes by using multiple/different email addresses, identities, or any other method will void that person’s votes and entry (if any), and he/she may be disqualified from further voting or other participation in the Contest. 

Winner Selection:  At the close of the Voting Period, the judges will select the potential Contest winner based on the criteria specified above.  Results of Public Voting may be considered by the judges, in their discretion, as one factor in assessing the public-appeal criterion, and do not directly determine the winner.

The potential Contest winner will be notified on or about December 19, 2022, via Direct Message on the relevant Social Media Platform or by email in the case of a VideoAsk Submission.  No liability is assumed for any winner notification that is lost, intercepted, or not received by a potential winner for any reason not attributable to the Sponsor.  If a potential winner does not respond within two (2) days after the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner may be disqualified and an alternate winner may be selected.  If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected.  Each potential winner may be required to execute an Affidavit of Eligibility, a Liability Release, and a Publicity Release (“Prize Claim Documents”).  If any potential winner is deemed a minor in his/her place of residence, a parent or legal guardian must sign all required Prize Claim Documents. 

PRIZE: One (1) Grand Prize is available: A $500 digital VISA gift card (“Prize”). The Prize is non-transferable.  No cash equivalent or substitution of the Prize is offered, except at the sole discretion of the Sponsor.  If the Prize becomes unavailable for reasons beyond the Sponsor’s control, the Sponsor may provide a prize of comparable or greater value.  The winner is responsible for all federal, state, and/or local taxes that may be due as a result of accepting a Prize.  The Prize may be delivered digitally to the winner.  VISA is a registered trademark of VISA, Inc., which is not a sponsor of or affiliated in any way with this Contest.

PARTICIPATION:  By entering the Contest, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Contest judges.  Submissions that have been tampered with or altered are void. No responsibility is assumed for: (i) lost, late, misdirected, damaged, garbled, incomplete or illegible entries, all of which are void; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, mobile device, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Sponsor due to technical problems; or (iii) any injury or damage to entrant’s or any other person’s computer or mobile device related to or resulting from participating in the Contest. 

The Sponsor reserves the right to: (i) permanently disqualify from any Contest it sponsors any person it believes has intentionally violated these Official Rules; and (ii) suspend, modify, or terminate the Contest if Sponsor believes, in its sole discretion, that malfunction, error, disruption, or damage is impairing or will impair the administration, security, fairness, integrity, or proper conduct of the Contest.  If the Contest is terminated before the designated end date, Sponsor will (if possible) select a winner from all eligible, non-suspect entries unaffected by the problem.

PUBLICITY/USAGE RIGHTS:  You acknowledge and agree that Sponsor (and those acting with its authorization) will have the non-exclusive right to copy, reproduce, edit, broadcast, and otherwise use your Submission, in whole or in part, in any way, in any medium whether now existing or later discovered, worldwide, in perpetuity, including but not limited to posting online, without consideration.  Participation in the Contest and/or receipt or use of any Prize further constitutes the winner’s consent for use of his/her Submission, name, likeness, voice, opinions, statements, biographical information, and/or hometown and state for promotional or advertising purposes in any media, worldwide, now known or hereafter developed, in perpetuity, without further review, notification, payment, or any additional consideration (unless prohibited by law).

Caution:  Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws.  Should such an attempt be made, the Sponsor reserves the right to seek damages from any such entrant to the fullest extent of the law. 

RELEASE OF LIABILITY:  By participating, you release the Sponsor and its parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all others associated with the development and execution of this Contest from any and against  any and all injury, loss or damage caused or claimed to be caused by your participation in the Contest and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize except as expressly provided in these Official Rules.  By participating, you agree that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney’s fees; (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses; and (d) these Rules and all disputes shall be governed by the internal laws of the State of New York, without regard to principles of conflicts of laws, any disputes shall be resolved exclusively in the state or federal courts in the State of New York, and you expressly consent to the jurisdiction of said courts and waive any objection thereto.  For New Jersey residents: Nothing herein prohibits recovery of damages or attorneys’ fees where required by statute.

DATA:  Any information you submit is subject to the Sponsor’s privacy policy located at https://jackpocket.com/privacy/.

WINNER NAME:  For the name of the winner, available approximately two weeks after the end of the Voting Period, send an email to my2022win@jackpocket.com, with “Jackpocket Winner of the Year Contest” in the subject line.  All such requests must be received by February 28, 2023.

INSTAGRAM, TWITTER, AND TIKTOK:  You release Instagram, Twitter, and TikTok and their respective parent companies, subsidiaries, affiliates, partners, employees, directors, agents, and advertising agencies from any and against any and all injury, loss, or damage caused or claimed to be caused by your participation in the Contest and/or the acceptance, awarding, receipt, use, and/or misuse of the Prize.  The Contest is in no way sponsored, endorsed, or administered by, or associated with, Instagram, Twitter, or TikTok.
