BY SUBMITTING ANY ENTRY, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES.
Eligibility. This “iHeartCountry Texas Getaway” Sweepstakes (“Sweepstakes”) is open to all natural persons who are legal residents of Arizona, Arkansas, Colorado, Idaho, Massachusetts, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, New Mexico, New York, Ohio, Oregon, Texas, Washington DC and West Virginia (“Participating Jurisdictions”) who are at least 18 years old (21 years old in Arizona and 19 years old in Nebraska) at the time of entry, excluding individuals referenced in the “Sponsor” paragraph below. Void outside of the Participating Jurisdictions. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law.
Sponsor. The Sweepstakes sponsor is Jackpocket Inc. (the “Sponsor”), located at 100 Park Avenue, Fl. 16, New York, NY 10017. Sponsor, the Released Parties (as defined below) and their respective affiliates, subsidiaries, successors, assignees, agents, representatives, officers, directors, shareholders, and employees and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Sweepstakes, including without limitation, the immediate family members and/or those living in the same household of such individuals, are not eligible to participate.
Entry Period. This Sweepstakes begins March 25, 2024 at 01:00:01 PM Eastern Time (“ET”) and ends on April 15, 2024 at 11:59:59 PM ET (“Entry Period”). All times are measured by Eastern Time (“ET”). The Sponsor’s database computer is the official timekeeping device for the Sweepstakes. Each “day” for purposes of these Official Rules is measured by ET.
How to Enter. There are two ways to enter during the Entry Period:
· Entry with Purchase Via App: First, download or open the Jackpocket mobile application (the “App”) and navigate to the Giveaway Page in the App; second, tap ‘Activate’ for this Sweepstakes; and third, place an official state lottery ticket order on the App from the state lottery where you are physically located in one of the Participating Jurisdictions. Every $1.00 spent on such ticket orders in the same account during the Entry Period after this Sweepstakes has been activated in that account is equal to one (1) entry in this Sweepstakes without need to activate again. Tapping ‘Activate’ does not provide a discount to purchase and is used only to trigger and keep track of entries. For new users, placing an order will require downloading the App, opening and registering an account (“Account”), and funding the Account prior to placing the order. All use of the App is subject to its general terms and conditions at jackpocket.com/tos. Lottery ticket orders made using promotional credits and/or promotional funds will not provide any entries in the Sweepstakes for the amounts of such promotional credits and/or promotional funds.
In order to enter with purchase via the App, you must have the following versions of iOS or Android, as applicable, installed:
Jackpocket Android Version 2.13.7 or higher
Jackpocket iOS Version 2.13.8 or higher
· Free Entry via Website: You may also enter for free, without any purchase, by doing the following (the “Free Entry”): First, download the App and open and register an Account, which is free to do; and second, after creating your Account, during the Entry Period, go to https://jackpocket.typeform.com/to/V5GwubNb (the “Site”), and complete the Typeform located there with the following information: full name, phone number, mailing address and the email address you used to register your Jackpocket Account. Each time you properly complete and submit the Typeform on the Site, you receive ten (10) entries, which is equal or greater than the average number of dollars currently spent per day by users of the App to purchase state lottery tickets. IMPORTANT: The email address that you enter in the Typeform MUST match the email address that you used to register your Jackpocket Account. If the email addresses do not match, then you will not receive any entries for the Typeform on which the email addresses did not match. Upon successful completion of both of the steps noted hereunder, you do not need to fund your Jackpocket Account in order to enter the Sweepstakes during the Entry Period and registering for a Jackpocket Account is free.
Limitations on Entries. LIMIT OF ONE HUNDRED (100) ENTRIES PER PERSON PER DAY DURING THE ENTRY PERIOD, REGARDLESS OF METHOD OF ENTRY, INCLUDING ANY COMBINATION OF ENTRIES GENERATED BY EITHER OR BOTH OF THE METHODS DESCRIBED ABOVE. Any attempt to submit more than the stated limit on entries by any means, including but not limited to use of multiple accounts, identities, email addresses or otherwise is grounds for disqualification. Each individual must submit his/her own entries. No third-party entry or entry through any sweepstakes service is permitted. Use of robotic or any other automated means of entry is strictly prohibited.
Winner and Prize. One Grand Prize is available: A trip for winner and one (1) guest to attend the iHeartCountry Festival in Austin, Texas. The prize includes: (a) round trip coach class air transportation for winner and one (1) guest between the major commercial airport nearest winner’s residence in a Participating Jurisdiction or adjacent state (as determined by Sponsor in its sole discretion) and Austin, TX (the “Destination”) departing on Friday, May 3, 2024 and returning on Sunday, May 5, 2024; (b) two (2) nights’ hotel accommodations (standard, single room, double occupancy); (c) one (1) gift card with a value of $100.00; and (d) two (2) tickets to attend the 2024 iHeartCountry Festival at Moody Center in Austin, TX (the “Venue”) on Saturday, May 4, 2024. Approximate total retail value of Grand Prize: $3,000.00.
Travel route, air carriers, hotel accommodations, and all elements of the Grand Prize will be determined solely by the Sponsor in its sole discretion, and all travel arrangements must be made through Sponsor or its designee at least fourteen (14) days prior to May 4, 2024. Travel and hotel accommodations are subject to availability. Air travel must be round trip. Winner and travel companion must travel together on the same itinerary. Sponsor will determine airline and flight itinerary in its sole discretion. Winner may be required to sign an Affidavit of Eligibility, Liability Release, and/or a Publicity Release prior to ticketing (the “Prize Claim Documents”). Travel companion also may be required to sign a Publicity and/or Liability Release. Failure to comply when requested may result in disqualification and award of prize to an alternate winner, time permitting. Any person taking part in the trip who is a minor under the laws of his/her state of residence must be accompanied by a parent or legal guardian who also must execute all documents on behalf of the minor. Winner and travel companion are responsible for obtaining the proper travel documentation (e.g., valid photo ID) prior to travel. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, including baggage fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, and federal, state, or local taxes are the responsibility solely of winner. No substitution or transfer of prize except in Sponsor’s discretion; provided that if the advertised prize becomes unavailable for any reason, an alternate prize of comparable value may be awarded. Actual value may vary based on airfare fluctuations and distance between departure and Destination. The difference in value of the actual trip package and the ARV will not be awarded. For any winner residing within 300 miles of Austin, Texas, ground transportation may be substituted in lieu of air transportation.
Winner and travel companion are responsible for complying with any travel requirements or restrictions set forth by applicable government agencies, airline, hotel, or other vendors offering services that are part of the trip prize. Failure to comply with any required travel requirements or restrictions may result in forfeiture of select elements of the prize or the entire prize. If certain elements of the trip cannot be fulfilled due to this or other events beyond Sponsor’s control, the remainder of the trip will be awarded as the total prize. Major credit card is required at hotel check-in to cover any incidental charges incurred not included in the prize description in these Official Rules.
Sponsor shall provide winner with applicable tax forms for withholding purposes and winner must return to Sponsor a W9 or W-8 BEN tax form, as applicable, prior to receiving the prize, if any such forms are required to be provided by Sponsor. Prizes may be subject to tax withholdings as required by law. Winner is solely responsible for determining winner’s tax liability that is in addition to or different from that described in this section. Winner understands there are inherent risks involved in travel to and from, and attendance to, the Venue and the Event and these risks may be present before, during, and after the Event. Winner agrees to accept the prize “as is” and entrants hereby acknowledge that Sponsor and iHeartMedia + Entertainment, Inc. not in any manner responsible or liable for any warranty, representation, or guarantee relative to the prizes, including warranties provided exclusively by a prize supplier.
Winner and winner’s guest, if any, must (i) conduct themselves at all times in a socially responsible, appropriate and well-behaved manner and (ii) comply with all Venue rules and regulations. Winner and/or winner’s guest may be ejected from the Venue if the winner and/or winner’s guest fail to comply with all Venue rules and regulations, behave in an inappropriate, belligerent or unruly manner as determined by iHeartMedia and Venue in their sole discretion; and, under such circumstances, iHeartMedia, Sponsor and/or Venue shall NOT have any liability or obligation to the winner and/or winner’s guest of any kind. Additional terms and conditions may apply to Venue and its surrounding events for which iHeartMedia and Sponsor shall not be responsible or liable in any way for any cancellations, losses or damages.
Prize Conditions: Sponsor may conduct a background check to confirm eligibility and compliance with these rules. By entering, you agree to cooperate reasonably with any such background check. Failure to cooperate may result in disqualification and selection of an alternate winner. If a potential winner or potential guest has engaged in or does engage in any conduct that could damage the reputation or business of Sponsor, as determined by Sponsor in its discretion, the potential winner may be disqualified and the prize may be awarded to an alternate winner, time permitting. Each potential winner and potential guest must also comply with all requirements for proper and appropriate behavior during any prize-related activities or events. Any inappropriate behavior, as determined by Sponsor in its sole discretion, may result in removal from any activity or event.
Drawing. Winner will be selected in a random drawing from among all eligible entries collected during the Entry Period, taking place on or about five (5) days after the end of the Entry Period. The drawing will be conducted by Sponsor, whose decisions and interpretations on all matters relating to the Sweepstakes and these Official Rules are final and binding in all respects. Sponsor reserves the right to disqualify any entrant or winner and may refuse to award a prize to a person who is not eligible or has violated a rule, gained unfair advantage in the Sweepstakes, or obtained winner status using fraudulent means, to be determined in Sponsor’s sole discretion. If there is a dispute about the identity of an entrant, prize will be awarded to the natural person associated with the email account listed in the applicable Jackpocket account. If a winner is found to be ineligible or not in compliance with Sweepstakes rules, such winner will be disqualified and the prize may be awarded to an alternate winner, time permitting. Each potential winner will be notified by phone and/or email using information associated with their Jackpocket account. Inability of Sponsor to contact a winner by telephone or email within two (2) business days after selection may result in disqualification of such winner and an alternate winner may be selected. If any prize notification is returned as undeliverable, then the prize will be forfeited and another winner may be randomly drawn, time permitting.
Odds. The odds of winning will depend on the number of eligible participants, according to the eligibility requirements in the Sweepstakes.
WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
General Terms. By entering this Sweepstakes, you promise to abide by the Official Rules and decisions of the Sweepstakes judges. Sponsor will not be responsible for any injury, damage, or loss of any kind arising out of your participation in the Sweepstakes. By entering, you release and agree to hold harmless the Sponsor and its subsidiary, and affiliated companies, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present parents, affiliates, officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to your participation in the Sweepstakes other than any obligation to award a prize in accordance with these Official Rules.
Except where prohibited by law, by accepting the prize, winner grants Sponsor a perpetual, worldwide, royalty-free license to use winner’s name, photograph, voice and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world, including, without limitation, in social media advertisements and announcements.
Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner(s) in a random drawing from all eligible, non-suspect entries unaffected by the problem. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
Only the type and quantity of prizes described in these Official Rules will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
Winner Name. The name of the winner (the “Winner List”) is available only for thirty (30) days after the Entry Period for the Sweepstakes ends. To receive the name of winners, where permitted by law, and/or a printed copy of the Sweepstakes Official Rules, please contact Sponsor by email at giveaways@jackpocket.com.
