Eligibility. This “Feel Like a Millionaire Day” Sweepstakes (“Sweepstakes”) is open only to natural persons who are legal residents of Arkansas, Colorado, Minnesota, New Hampshire, New Jersey, New Mexico, New York, Ohio, Oregon, Texas and Washington, D.C. (“Participating Jurisdictions”) who are at least 18 years old at the time of entry, excluding individuals referenced in the “Sponsor” paragraph below.  Void outside of the Participating Jurisdictions, and where prohibited.  This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. 

Sponsor:  The Sweepstakes sponsor is Jackpocket Inc. (“Sponsor”), located at 145 W 45th St, Floor 12, New York, New York 10036.  Sponsor and its affiliates, subsidiaries, successors, assigns, agents, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Sweepstakes, and their respective representatives, officers, directors, shareholders, members and employees, including without limitation, the immediate family and/or household members of such individuals, are not eligible to participate.   

Entry Period.  This Sweepstakes begins on May 20, 2022 at 12:00:01 AM Eastern Time ("ET”), and ends on July 1, 2022 at 11:59:59 PM ET (“Entry Period”).  Each “day” for purposes of these Official Rules is measured by ET. 

How to Enter.  There are two ways to enter.

1. Automatic with Purchase. During the Entry Period, place an official state lottery ticket order on the Jackpocket mobile application (“App”) from the state lottery where you are physically located in one of the Participating Jurisdictions, and use the following promo code at checkout: BEACH.  Every $1.00 spent on such ticket orders in the same account during the Entry Period after the BEACH promo code has been used once in that account is equal to one (1) entry in the Sweepstakes (including the promo code order) without need to enter the promo code again.  The promo code does not provide a discount to purchase and is used only to trigger and keep track of entries. For new users, placing an order will require downloading the Jackpocket mobile application, opening and registering an account, and funding the account prior to placing the order.  All use of the Jackpocket mobile application is subject to its general terms and conditions at jackpocket.com/tos.  

2. Free Entry. You may also enter for free, without any purchase, by doing the following: (1) Download the App and open and register an account, which is free to do; and (2) After creating your account, during the Entry Period, go to https://jackpocket.typeform.com/to/nOtujrhw (the “Site”), and complete the typeform located there with the following information: full name, phone number, mailing address and the email address you used to register your Jackpocket account.  Each time you properly complete and submit the typeform on the Site, you receive ten (10) entries, which is equal or greater than the average number of dollars currently spent per day by users of the App to purchase state lottery tickets. 

IMPORTANT: The email address that you enter in the typeform MUST match the email address that you used to register your Jackpocket account. If the email addresses do not match, then you will not receive any entries for the typeform on which the email addresses did not match.  Upon successful completion of both of the steps noted hereunder, you do not need to fund your Jackpocket account in order to enter the Sweepstakes during the Entry Period and registering for a Jackpocket account is free.   

Limitations on Entries. LIMIT ONE HUNDRED (100) ENTRIES PER PERSON PER DAY DURING THE ENTRY PERIOD, REGARDLESS OF METHOD OF ENTRY, INCLUDING ANY COMBINATION OF ENTRIES GENERATED BY EITHER OR BOTH OF THE METHODS DESCRIBED ABOVE.  Any attempt to submit more than the stated limit on entries by any means, including but not limited to use of multiple accounts, identities, email addresses or otherwise is grounds for disqualification.  Each individual must submit his/her own entries.  No third-party entry or entry through any sweepstakes service is permitted.  Use of robotic or any other automated means of entry is strictly prohibited.

Winner and Prize.  One Grand Prize is available.  A trip for winner and one (1) guest to winner’s choice of one (1) of the following Club Med destinations:  Club Med Turkoise, Club Med Cancun or Club Med Dominican Republic (“Destination”). The trip package includes: (a) round trip, first class air transportation for two (2) from a major airport nearest winner’s home to the major airport nearest to the Destination; (b) five (5) nights' accommodations (standard single room, double occupancy) at the selected Club Med Destination; (c) ground transportation to and from airport nearest the Destination and the selected Club Med Destination; (d) one (1) luxury travel pack for winner and winner’s guest valued at approximately $775.00; (e) one (1) spa treatment for winner and winner’s guest at the selected Club Med Destination; and (f) taxes and gratuities for the ground transportation to and from airport nearest the Destination and the selected Club Med Destination, dining at the selected Club Med Destination, the bars at the selected Club Med Destination and the spa treatment noted above for winner and winner’s guest at the selected Club Med Destination. Approximate retail value of prize: $10,000.

Travel route, air carriers, hotel accommodations, and all elements of the Grand Prize will be determined solely by the Sponsor in its sole discretion, and all travel arrangements must be made through Sponsor.  Winner must book the trip within twelve (12) months from the drawing date and complete the trip within twenty-four (24) months from the drawing date. Trip must be booked at least sixty (60) days prior to departure. Travel and accommodations are subject to availability and blackout dates.  Air travel must be round trip. Winner and travel companion must travel together on the same itinerary.  Sponsor will determine airline and flight itinerary in its sole discretion. Winner and travel companion may be required to sign an Affidavit of Eligibility, Liability Release, and/or a Publicity Release prior to ticketing (the “Prize Claim Documents”).  Any person taking part in the trip who is a minor under the laws of his/her state of residence must be accompanied by a parent or legal guardian who also must execute all documents on behalf of the minor. Winner and travel companion are responsible for obtaining the proper travel documentation (e.g., valid photo ID and/or passport with a minimum validity 6 months after the date of return) prior to travel.  No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, including baggage fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, and federal, state, or local taxes are the responsibility solely of winner. If air travel is not required due to winner’s proximity to Destination, ground transportation will be substituted for air travel at Sponsor’s sole discretion.  

Winner and travel companion are responsible for complying with any COVID-19 requirements set forth by applicable government agencies, airline, hotel, or other vendors offering services that are part of the trip prize. Failure to comply with any required COVID-19 requirements may result in forfeiture of select elements of the prize or the entire prize. If certain elements of the trip cannot be fulfilled due to this or other events beyond Sponsor’s control, the remainder of the trip will be awarded as the total prize. 

Winner is solely responsible for any applicable federal, state, and local taxes as a result of acceptance of the prize.  No substitution or transfer of prize except in Sponsor’s discretion; provided that if the advertised prize becomes unavailable for any reason, an alternate prize of comparable value may be awarded.  Actual value may vary based on airfare fluctuations and distance between departure and destination.  The difference in value of the actual trip package and the ARV will not be awarded.   

Prize Conditions:  Sponsor may conduct a background check to confirm eligibility and compliance with these rules.  By entering, you agree to cooperate reasonably with any such background check.  Failure to cooperate may result in disqualification and selection of an alternate winner.  If a potential winner or potential guest has engaged in or does engage in any conduct that could damage the reputation or business of Sponsor, as determined by Sponsor in its discretion, the potential winner may be disqualified and the prize may be awarded to an alternate winner, time permitting.   Each potential winner and potential guest must also comply with all requirements for proper and appropriate behavior during any prize-related activities or events. Any inappropriate behavior, as determined by Sponsor in its sole discretion, may result in removal from any activity or event. 

Drawing.  Winner will be selected in a random drawing from among all eligible entries collected during the Entry Period, taking place on or about July 8, 2022.  Decisions of the judges are final and binding on all matters relating to the Sweepstakes and these Official Rules.  Any entrant or potential winner may be disqualified and forfeit prize if they are not eligible or violate a rule, gained unfair advantage in the Sweepstakes, or obtained winner status using fraudulent means.  If there is a dispute about the identity of an entrant, prize will be awarded to the natural person associated with the Jackpocket account or provided by email.  If a winner is found to be ineligible or not in compliance with Sweepstakes rules, such winner will be disqualified and an alternate winner will be awarded the prize.  Each potential winner will be notified by phone and/or email using information associated with their Jackpocket account.  Inability of Sponsor to contact a winner by telephone or email within three (3) business days after selection may result in disqualification of such winner and an alternate winner may be selected.  If any prize is returned as undeliverable, then such prize will be forfeited and may be awarded to an alternate winner.  Each potential winner may be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release; failure to comply when requested may result in disqualification and award of prize to an alternate winner. 

Odds.  The odds of winning will depend on the number of eligible entries received. 

WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

General Terms.  By entering this Sweepstakes, you promise to abide by the Official Rules and decisions of the Sweepstakes judges.  Sponsor will not be responsible for any injury, damage, or loss of any kind arising out of your participation in the Sweepstakes.  By entering, you release and agree to hold harmless the Sponsor and its subsidiary, and affiliated companies, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present parents, affiliates, officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to your participation in the Sweepstakes other than any obligation to award a prize in accordance with these Official Rules. 

Except where prohibited by law, by accepting the prize, winner grants Sponsor a perpetual, worldwide, royalty-free license to use winner’s name, photograph, voice and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world, including, without limitation, in social media advertisements and announcements.  

Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein.  If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner(s) in a random drawing from all eligible, non-suspect entries unaffected by the problem.  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.  

Only the type and quantity of prizes described in these Official Rules will be awarded.  If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s).  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.

By entering the Sweepstakes, you further agree that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney's fees; and (c) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses.  These rules and any disputes relating hereto are governed by the internal laws of the State of New York without regard to principles of conflicts of laws, and by entering, you consent to the exclusive jurisdiction of the state and federal courts in the State of New York for resolution of any disputes relating to the Sweepstakes and waive any objection thereto.

Winner’s Name.  For the winner’s name, available approximately 15 days after the Entry Period closes, please contact Sponsor by email at beach@jackpocket.com.  Requests must be received by July 31, 2022.
